Previous Divorce/Annulment
A
person whose previous
marriage was dissolved
or annulled in Canada,
must bring with them
the original or court-certified copy of the final decree dissolving or annulling the marriage when
applying for the marriage license.
If the marriage was dissolved
or annulled in a jurisdiction other than Canada,
the applicants must obtain authorization from
the Minister of Consumer and Commercial Relations
before a marriage license may be issued. To obtain
this authorization please follow these steps:
1) We will fax you 1 “Marriage
License Application” and a “Statement
of Sole Responsibility” form for each divorce/annulment.
2) Please complete all forms fully
and accurately.
3) Send the following to us by
registered mail (we cannot be responsible for
papers lost in the mail):
a) a certified copy of the decree
of divorce or annulment (certified by the proper
court officer in the jurisdiction the divorce/annulment
was granted or sealed by the court). If a decree
is in a language other than English or French,
include a certified translation.
b) a completed
marriage license application signed by both
applicants.
c) a Statement of Sole Responsibility
for each divorce signed by both applicants.
4) We will take the above documents
to an Ontario lawyer, who will document his legal
opinion, citing reasons why the divorce or annulment
should be recognized in the Province of Ontario.
Representing the applicants, he will then submit
all of the above documents to the Office of the
Registrar General.
5) Where a spouse has died, proof
of death of the spouse must be provided if death
occurred outside Ontario.
